What You Need to Know About Gaming Service Providers

Gaming Service Provider Basics

• A Gaming Service Provider is defined as a person who provides non-gaming related goods or services to a slot machine applicant or licensee.
• Gaming Service Providers must be either registered or certified by the Board.
• Gaming Service Provider applications must be submitted to the Board by a slot machine licensee or applicant.
• Gaming Service Provider may be authorized to conduct business with a slot machine licensee or applicant prior to completion of its background investigation provided a completed registration or certification application has been filed.
• Registered or certified Gaming Service Providers are required to submit diversity plan statements with their applications and must submit an annual diversity compliance report assessing their performance for the previous year.
• The Board will maintain on its website, at http://gamingcontrolboard.pa.gov, a list of Authorized Gaming Service Providers and a list of Approved Gaming Service Providers from which the state’s slots facilities may purchase non-gaming related goods or services as well as a list of Prohibited Gaming Service Providers.

Types of Gaming Service Provider Forms/Applications

A. Notification of Material Gaming Service Provider Form

• A slot machine applicant or licensee must complete and submit a Notification of Material Gaming Service Provider Form prior to compensating a Gaming Service Provider between $15,000 - $100,000 within a consecutive 12 month period.

B. Publicly Traded Gaming Service Provider Form

• A person, or subsidiary of a person, that is publicly traded may be authorized to provide goods or services to a slot machine licensee or applicant without applying for registration or certification if the person meets the Board’s definition of publicly traded and submits a completed, publicly traded gaming service provider form along with $250 for the application fee.

C. Registered Gaming Service Providers

• • An individual or entity must file a Gaming Service Provider registration application if the total dollar amount of business is or will be greater than $100,000 but less than $500,000 with one or more slot machine applicants or licensees within a consecutive 12 month period.
  • The fee for the Gaming Service Provider registration application is $500 for the entity and $60 for each qualifier listed¹. The registration fee is $2,000.
  • A Gaming Service Provider registration is valid for 4 years.
  • The Gaming Service Provider registration application must include forms from the registered Gaming Service Provider applicant’s employees who will be working on the gaming floor or in a restricted area at the facility. The forms are as follows:

• A gaming employee application and disclosure information form is required for any employee of a registered or certified Gaming Service Provider who will be performing job duties in a restricted area or who will have any contact with gaming equipment. The application fee is $350.
• A non-gaming employee application and disclosure information form is required for any employee of a registered or certified vendor who will be performing job duties on the gaming floor but whose job duties do not require the employee to touch or have contact with gaming equipment other than exterior cleaning. The application fee is $60.

D. Certified Gaming Service Providers

• • A person or entity must file a Gaming Service Provider certification application if the total dollar amount of business is or will be greater than $500,000 with one or more slot machine applicants or licensees within a consecutive 12 month period.
  • The fee for the Gaming Service Provider certification application is $2,500 and the certification fee is $4,000.
  • A Gaming Service Provider certification is valid for 4 years.
  • A certified Gaming Service Provider application is a more in depth application than the Gaming Service Provider registration application and must include:

• A Gaming Service Provider Private Holding Company Form for each affiliate, intermediary, subsidiary, holding company or trust that has a 20% or greater direct interest in the applicant. The fee is $500 per application.
• A Personal History Disclosure Form for each owner, officer, and director and each sales person who solicits business from or has regular contact with any representative of a slot machine licensee or applicant. The fee is $1,000 per application. These certifications are valid for four years.
• A gaming employee application and disclosure information form for any employee who will be performing job duties in a restricted area or have any contact with gaming equipment. The application fee is $350.
• A non-gaming employee application and disclosure information form for any employee who will be performing job duties on the gaming floor but whose job duties do not require the employee to touch or have contact with gaming equipment other than exterior cleaning. The application fee is $60.

1. The fees indicated are non-refundable deposits required to cover the reasonable and necessary costs of the background investigation. No additional costs or expenses related to the background investigation will be billed, unless an investigator is required to travel in overnight status or stenographic services are required. In either case, actual costs incurred by the Board shall be reimbursed by the applicant.
